Commercial contracts management in EPC construction project : a case study of Vung Ang 1 Thermal Power Plant Project

AbstractWith the social-economic blooming in Vietnam during the recent decade, the form of construction project performed under the type of EPC Contract (EPC Contractor) has been applied for many construction projects, having brought many great interests to the country. Through this form of application, the enterprises operating in the construction industry (including industrial, civil engineering, and infrastructure construction) have grown-up fairly fast. These enterprises have approached the modern management methods and tools. They have worked together and have learnt and accumulated valuable knowledge and experiences for themselves. However, due to the project complexity, greatly big size, high requirements and risks, are in addition with the currently unavoidable restrictions of Vietnam (such as knowledge, technology, management philosophy and measures, financial capacities), this form has shown its restrictions, disadvantages and weaknesses. How to remedy the restrictions, ensuring not only the generally social-economic development targets but also the reputation, trade-name and efficiency for operating enterprises - these are the highly difficult and challenging issues which are being much concerned by policy makers, leaders, managers, scholars, specialists and researcher teams in order to soon find out the appropriate resolutions. We all may see that the management of single construction project is always associated with the contract management task. Bearing the above mentioned expectations, this report will approach and deeply go into learning, analyzing and providing comments about the contract management performed in a construction project under the mechanism of EPC Contractor – i.e. the Vung Ang No. 1 Thermal Power Plant Project. On the basis of generalized theories of project management, the report will mention and analyze the factors related to the project contract management work. The report will mention about the advantages, disadvantages and restrictions in the performed management activities, and then it will provide the proposed recommendations for improving the contract management task – an important working task in management of any construction project, especially the ones performed under the type of EPC Contractor. The author expects his given comments may become some valuable for the managers, the researchers and the learners. Expecting this theme will be more deeply and broadly studied with several another similar projects in order to find out effective measures for improving the construction projects management in the country nowadays.
