Abstract | Construction industry in India has substantial economic importance. It gives job opportunities t o all the people irrespective of their skill. Construction industry in India gives the employment to 33 million people and stands in the second position among all the industries after agriculture. Employment for most of the labor in Indian construction ind ustry is on contract basis i.e., they a re given work for a short time. Most of the construction workers employed are various other sectors such as agriculture, handlooms etc. These people migrated to construction sector due to the extinction of the previou s sectors. As the construction i ndustry is growing in India day by day more workers migrated to get money. So, when the employers recruit these kinds of workers, they face delays in projects due to accidents and fatalities. Because these workers don’t have any knowledge and training rega rding c onstruction safety. When these workers work in the site, they are unable to predict the risks and expose to various hazards. Present study will focus on the safety law and regulations in Indian construction sector. A qualitative study has been condu cted on nine building construction companies and four government officials in the government regulatory organization’s related to construction safety in India. In India Central and State governments are unable to enforce the BOCW Act 1996 in an effective w ay. W hen there is lack of enforcement construction companies will not comply and implement the safety regulations, as result more number of accidents will be taken place. Most of the construction companies in India are not c omplying and implementing the sa fety regulations in the BOCW Act 1996. Major challenges faced by government agencies regarding the enforcement of BOCW Act 1996 are lack of awareness on construction safety and BOCW Act 1996, lack of inspectors, lack of regi strations by establishments, ins pecti on system, lack of training in construction safety and more number of acts which are to enforced parallel with the BOCW Act 1996. |
