AbstractIndia is and has been always a growing economy with outstanding GDP growth rates providing a great place for infrastructure development, there is a great demand for the transportation facilities with growing economy and growing populations. In order to meet all the transportation facility requirements,the government is allocating great budgets and emphasis on the actions plans and schemes on the development, construction and maintenance of infrastructure. Due to this there have been and are tremendous amounts of contracts being offered to various contractors for building of the various road projects catering the needs of public with boost in economy, thus various national highway projects are being given a great anamount of emphasis.There have been reports of the global disputes in construction of transportation facilities amountingto about 30 % of the total global disputes, requiring animmediate correction for reduction in number of disputes and clear settlement between the parties. Therefore, the mainemphasis of the study has been to observe the claim situation of the road construction highway projects in India. The amountof the contractor’ssuccess in the dispute settlements, the main root causes forthe claims to be raised by the contractor, the reasons for the efficiency and inefficiency inthe claim settlement process along with the reasons, all these haveto be kept in mind to bring out the solutions for reduction in the disputes between the parties and easy settlement conceived between the parties at a very early stage of the project.For this purpose,the 3 case studies of NHAI (national highway authority of India) have been taken into consideration and pattern matching between the 3 cases has been done to bring out the various objectives set, finally making recommendations for reducing and improving the overall claim and dispute settlement in India.
