Abstract | Since starting the program of economic and social reform in 1986, Vietnam has emerged as one of the fastest growing economies in Southeast Asia . According to the forecast, construction industry will hit a growth of 7% over the period 2006 - 2010. The highlight of this was to say Vietnam will become a large construction area with infrastructure including roads , bridges, residential buildings and factories. However, in the performing process, risks in contract management by investors also frequently occur. It can be seen that the construction contract is one of the important legal instrument for the implementation of infrastructure projects. Due to the nature of the construction industry involving complex issues of technical, so many related parties with conflicting interests which is prone to disputes and legal risk is higher than the other. Thus the risk of construction in general and construction contracts in particular are very important for investors in the process of managing contractors. It can be seen that any mistake in design, in the development or selection of materials of inferior quality or lack of compliance with legal requirements can lead to serious legal consequences. Meanwhile, the owner or contractor will be responsible or bear the cost when something goes wrong? To answer this question, it is important to understand the legal risks and contract during construction. This presentation will include an overview of the legal risks in construction contracts, the cause of the legal risks of construction projects in Vietnam |
