Abstract | Sir Latham (1994) has said “No construction project is risk free. Risk can be managed, minimized, shared, transferred, or accepted. It cannot be ignored.” Construction projects are a high-risk endeavor from start to finish. The risks in a construction project cannot be avoided completely but they can be dealt with contracts. The success of construction contractors may depend on how well they manage project risks. Managing risk can be handled not only construction practices (for example: proven construction methods, use of modern equipment, experienced personnel, and stringent safety programs) but also by careful contract preparation and administration. The purpose of this report is to analyze the management of contractual risks from contractor’s point of view. It is not only about analysis of conditions of contract but also how to administer the contract to manage contractual risks and finish the project in good quality, safety, on schedule and with profit as desired. Through case study of The Lancaster Hanoi project, a high-rise building project in Ba Dinh district, Hanoi city, contractor’s contractual risks and contract administration will be investigated and analyzed. This report also has established a framework for improvement for contractors to consider when preparing or entering into their next construction contracts. |
